Terms & Conditions of Sale

 1. Introduction:

Welcome to Trickett Hardware. These Terms & Conditions (“T&C”) govern your purchase of physical products from our website Tricketthardware.com, and constitute a legally binding agreement between you and us. By placing an order through the Site, you agree to be bound by these T&C. If you do not agree, please do not use our Site or place an order.

 

2. Definitions:

“Customer”, “you”, “your” means the individual or entity that purchases products from us. “Products” means the physical goods offered for sale on the Site. “Order” means your purchase of one or more Products from us. “Shipping Address” means the address to which the Products will be shipped.

 

3. Eligibility:

By placing an Order, you represent and warrant that: You are at least 18 years old (or the age of majority in your jurisdiction); you have legal capacity to enter into these T&C; the information you provide when placing an order is true, accurate, current and complete.

 

4. Orders & Acceptance:

All Orders are subject to our acceptance. We may, at our discretion, refuse or cancel any Order for any reason (including, without limitation, product availability, errors in description or pricing, or suspected fraud). When you place an Order, you will receive an email acknowledging receipt of your Order. This does not constitute acceptance. We will confirm acceptance by sending a separate “Shipping Confirmation” email, at which point the contract between you and us is formed. We reserve the right to impose quantity limits or refuse service to any customer.

 

5. Pricing, Taxes & Payment:

Product prices are shown on the Site and are valid only at the time of placing your Order, unless otherwise stated. Payment is due immediately at the time the Order is placed via the payment methods made available on the Site.

 

6. Sales tax:

If you are shipping a Product to a West Virginia address (or other jurisdiction where we have a tax obligation), you will be responsible for any applicable sales tax. Specifically, in West Virginia, remote sellers and marketplace facilitators that exceed certain thresholds (gross sales > $100,000 or 200+ separate transactions for delivery into WV) are required to collect and remit sales or use tax. State Regs Today +2 West Virginia Tax Division +2 Shipping and handling charges, if any, are shown at checkout and are your responsibility.

7. Shipping, Delivery & Risk of Loss:

We will ship the Product(s) to the Shipping Address you provide. Delivery dates are estimates only; we are not responsible for delays caused by carriers or events outside our control. Risk of loss and title for Products pass to you when we deliver the Product(s) to the shipping carrier.

8. Returns, Refunds & Cancellations:

9. Product-Use & Warranties:

Our Products are intended for normal, lawful, personal use insofar as described on the Site. If your jurisdiction does not allow certain disclaimers or limitations, then those parts of these T&C do not apply to you.

10. Limitation of Liability:

To the maximum extent permitted by law (including West Virginia law), in no event shall we, our affiliates, officers, directors, employees or agents be liable for: indirect, incidental, special or consequential damages; loss of profits, data or business interruption; for any damages arising out of or in connection with your use of or inability to use the Products or Site. Our maximum liability to you in respect of any Order or Products shall not exceed the amount you paid for the Products giving rise to the claim.

11. Intellectual Property:

All content on the Site (including text, graphics, logos, images, software) is our/ our suppliers property or licensed to us and is protected by applicable intellectual property laws. You may view and download one copy of the content for personal, non-commercial use; you may not modify, reproduce, distribute or exploit any of the content without our express written permission.

 

12. Governing Law & Dispute Resolution:

These T&C and your Order shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these T&C or your Order shall be brought exclusively in the state or federal courts located in Randolph County, West Virginia, and you consent to the personal jurisdiction of such courts.

 

13. Changes to Terms & Conditions:

We reserve the right to update or change these T&C at any time. The “Last updated” date at the top will reflect the most recent revision. Your continued use of the Site or placing of an Order after changes means you accept the new T&C. For clarity, any Orders placed before a change shall be governed by the T&C in effect at the time of that Order, unless we notify you otherwise.

 

14. Sever ability & Waiver:

If any provision of these T&C is held unenforceable or invalid under applicable law, such provision shall be struck and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision under these T&C shall not constitute a waiver of such right or provision.
